Terms of Use

The Reserves and Former Members portal (website) (Portal) will be used to collect, store and maintain up-to-date information about AFP Former Members and AFP Reserves. This Portal will assist with streamlining communications and engagement with AFP Former Members and Reserves, seeking EOIs for Reserve placements and matching skills profiles for Reserve placements.

By logging into and using the Portal, you acknowledge that you have read and agree to comply with these Terms of Use as published on the Portal and as updated from time-to-time. These Terms of Use must be read in conjunction with the Privacy Notice.

The material on this Portal is provided for general information only and on the understanding that the Commonwealth is not providing professional advice on a particular matter. This Portal is not a substitute for independent professional advice. If necessary, you should obtain appropriate professional advice relevant to your particular circumstances.

The AFP makes every effort to ensure that material on this Portal is accurate and up-to-date. However, the AFP does not guarantee, and does not accept any legal liability whatsoever arising from or connected to, the accuracy, reliability, currency or completeness of any material contained on this Portal or any linked site.

The AFP recommends you exercise your own skill and care with respect to your use of this Portal and carefully evaluate the accuracy, currency, completeness and relevance of the material on this Portal for your purposes.

Content and access requirements

This Portal contains sensitive or personal information of Reserves and Former Members.

The Commonwealth (as represented by the AFP) owns intellectual property rights to all relevant content on the Portal. The AFP actively monitors user access to this Portal and published Portal content. Apart from any use permitted under the Copyright Act 1968 (Cth) or unless otherwise expressly indicated (including by use of a Creative Commons logo) all other rights are reserved.

If you provide material to the AFP to publish on the Portal (for example, by writing a testimonial or other contribution) or otherwise upload content to the Portal, you:

  • agree that all intellectual property rights in such material will vest in the AFP on creation;
  • consent to the AFP amending the material or choosing not to publish the material for any reason (without providing a reason), including where material breaches the AFP Code of Conduct or other applicable governance;
  • indemnify the AFP for any claim of infringement of third party intellectual property rights; and
  • indemnify the AFP for any other claim that may be brought against the AFP in connection with the material you provided.

Any information published on the Portal as part of a testimonial will constitute prescribed information as defined by section 60A of the Australian Federal Police Act 1979 (Cth) (AFP Act) (so far as the information relates to, or arises from, the carrying out of AFP duties). Portal users should note that dissemination of prescribed information to people who are not either: a) an AFP employee or b) a former AFP employee specifically authorised to access the material, may constitute a breach of section 60A.

By accessing this Portal, you agree that you will not:

  • share your login information with any other person;
  • frame, reformat or alter files, pages, images, information and materials from this Portal on any other website or in any other format; or
  • re-transmit, download, print, display, copy or distribute or commercialise the information or material on this Portal without seeking prior written approval from the AFP,

unless (regarding dot points 2 and 3) the AFP has provided, within the specific published content, written authority to share or distribute that specific information or materials, subject to any conditions in the authority.

The AFP reserves the right to suspend or deactivate your access to this Portal for non-compliance with these requirements or pursue any other legal rights that the AFP may have in relation to infringement of intellectual property rights or non-compliance with legislation (for example, section 60A of the AFP Act).

Freedom of Information

The AFP is an agency for the purposes of the Freedom of Information Act 1982 (FOI Act). The AFP Freedom of Information Policy details how you can formally access documents held in the Portal under the FOI Act.

Security

The AFP has various security controls to protect this Portal from unauthorised access.

Users should always be aware that the World Wide Web (the web) is an insecure public network. In accessing the web, there is the potential risk that your transactions are being viewed, intercepted or modified by third parties, or that files you download may contain computer viruses, disabling codes, worms or other defects.

The AFP does not accept any liability for any interference with, or damage to, your computer system, software or data occurring in connection with or relating to this Portal or your use. You are encouraged to take appropriate and adequate precautions to ensure that whatever is selected from this Portal is free of viruses or other contaminations that may interfere with or damage your computer system, software or data.

The AFP does not make any representation, guarantee or warranty that this Portal will operate error free and without interruption.

Alterations

The AFP may terminate access to the Portal, suspend or alter content of the Portal or these Terms of Use at any time without notice to you. These Terms of Use survive any such termination, alteration or suspension.

General

These Terms of Use are governed and constructed in accordance with the laws of the Australian Capital Territory, Australia. You submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory, Australia, and any courts which may hear appeals from those courts in respect of any proceedings in connection with these Terms of Use, or the use of this Portal.
